Brewers Association Volunteer Liability Agreement
The Brewers Association (hereafter referred to as “BA” or “Association”) appreciates your willingness to volunteer in connection with BA events and activities, including but not limited to the Craft Brewers Conference & BrewExpo America ®, Great American Beer Festival ®, World Beer Cup ®, related competitions, conferences, festivals, gatherings, warehouse activities, and affiliated events and activities (referred collectively to as “Activities”). By signing this Agreement, you acknowledge and agree to the following:
I understand that my participation in BA Activities is voluntary. I am not an employee of the BA and am not entitled to wages, benefits, unemployment benefits, or worker’s compensation benefits in return for my service to the Association and its Activities. I, the undersigned Volunteer (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to hold liable the Association, its officers, directors, employees, sub-contractors, sponsors, or affiliates from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Association’s Activities wherever, whenever, or however the same may occur.
I understand and agree that the Brewers Association is not responsible for any injury or property damage arising out of Activities I am voluntarily participating in, even if caused by their ordinary negligence or otherwise. I understand that participation in volunteer Activities involves certain risks, including, but not limited to, serious bodily injury, illness, emotional distress, property damage, and death. I am voluntarily participating in such Activities with knowledge of the danger involved relating, but not limited, to alcohol service and intoxicated attendees; handling alcoholic beverages, kegs, glass containers, pallets, and freight; heavy lifting and repetitive physical activity; slips, trips, and falls; vehicles, equipment, and transportation; electrical equipment and temporary event infrastructure; weather conditions; food handling and consumption; exposure to illness; negligence of other participants, attendees, vendors, contractors, or third parties; and other unforeseeable risks association with warehouse and event operations. I agree to accept all risks of participation.
I also agree to indemnify and hold harmless the Association for all claims arising out of my participation in the Activities taking place at the Brewers Association Warehouse, located at 587 S Taylor Ave, Louisville, Colorado, the headquarters located at 1327 Spruce Street, Boulder, Colorado, and any venue in which operations and Activities take place.
I represent that, to my knowledge, I am physically and mentally capable of participating safely in the Activities for which I am volunteering. I agree to inform the BA of any medical conditions, restrictions, allergies, or limitations that may affect my participation or require emergency treatment. In the event of illness, injury, or emergency, I authorize the BA and emergency personnel to secure medical treatment on my behalf, including transportation by ambulance if deemed necessary. I understand that I am solely responsible for all medical expenses incurred as a result of my participation. I also acknowledge that the BA maintains volunteer accident insurance but that such coverage may be limited and does not guarantee payment of medical or related expenses for me, my parents, guardians, trustees, heirs, executors, administrators, successors, and assigns.
I understand that behaviors including harassment, discrimination, violence, theft, property damage, possession or use of illegal drugs, unsafe operation of equipment or vehicles, failure to follow safety instructions, or alcoholic impairment during activities is strictly prohibited. I agree to comply with all BA policies, rules, volunteer instructions, venue rules, applicable laws, and the Association’s Code of Conduct. I understand that a violation of such nature may result in immediate removal from volunteer Activities.
I understand that this document is intended to be as broad and inclusive to the fullest extent permitted by law of the state in which the volunteer Activities take place, I hereby release, waive, discharge, and covenant not to sue the Brewers Association, its officers, directors, employees, sub-contractors, sponsors, or affiliates, and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY KIND.
